Participant Waiver and Release of Liability

By checking the acknowledgment box when booking through Acuity Scheduling, I (“Participant”) confirm that I have read, understood, and agreed to the following terms and conditions as a prerequisite to participating in services offered by Amy Tobey DBA Olive Branch Yoga, an extension of Olive Branch Yoga LLC (“Olive Branch Yoga”):

1. Health and Physical Condition

I affirm that I am in good health and physically able to participate in yoga, sound healing, Reiki, or other wellness activities. I have either (a) been examined by a licensed physician within the past six months and found fit to engage in such activities, or (b) chosen to participate without such examination, accepting full responsibility for my health and safety.

2. Assumption of Risk

I acknowledge that yoga, sound healing, Reiki, and related activities may involve physical exertion, emotional release, or other risks that could result in injury, illness, aggravation of pre-existing conditions, or, in rare cases, death. I voluntarily assume all risks, known and unknown, associated with participation.

3. Personal Responsibility

I agree to listen to my body, modify as needed, and inform Amy Tobey / Olive Branch Yoga of any injury, limitation, or condition that may affect safe participation. I accept full responsibility for my own well-being during and after sessions.

4. Release of Liability

I release, waive, and forever discharge Amy Tobey, DBA Olive Branch Yoga, Olive Branch Yoga LLC, and its agents, contractors, successors, and assigns from any and all claims, demands, damages, or causes of action related to participation, including but not limited to property loss, theft, bodily injury, disease, disability, emotional distress, or death, whether arising on or off premises.

5. Pregnancy

If I am pregnant or become pregnant, I will consult with my obstetrician before attending classes. I assume full responsibility for any risks to myself and my unborn child and release Olive Branch Yoga from any liability.

6. Minors

If the participant is under the age of 18, a parent or legal guardian must also complete the booking and acknowledgment on their behalf, confirming acceptance of all risks and terms.

7. Payment and Refund Policy

All fees paid for classes, workshops, or events are non-refundable.

Note on Payments: All payments are processed under Olive Branch Yoga LLC / Amy Tobey DBA Olive Branch Yoga.

8. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the State of Illinois. Any dispute arising from this Agreement shall first be submitted to mediation or arbitration through the American Arbitration Association before resorting to litigation. If unresolved, jurisdiction shall lie exclusively in the 21st Judicial Circuit Court of Kankakee County, Illinois.

9. Severability

If any provision of this Agreement is held invalid under applicable law, the remaining provisions shall remain fully enforceable.

Acknowledgment

By checking the box when booking through Acuity Scheduling, I acknowledge that I have read, understood, and voluntarily agreed to the terms of this Liability Waiver and Release of Liability. I understand that by doing so, I may be waiving certain legal rights, including the right to sue.
